Bankruptcy (Creditors’ Remedies)
Carnahan Evans routinely represents lenders in Chapter 7, 11, 12 and 13 bankruptcy proceedings. We have represented clients in multimillion dollar bankruptcy workouts including negotiation of adequate protection and cash collateral arrangements and debt restructurings. We have substantial experience representing creditors in contested matters relating to relief from the automatic stay as well as adversary proceedings including representation of clients in preference actions initiated by bankruptcy trustees.
In addition to providing representation of creditors in bankruptcy proceedings, we also have substantial experience representing creditors in restructuring credit relationships in an effort to avoid the commencement of bankruptcy proceedings. We have successfully represented creditors in restructuring large commercial credits secured by a wide variety of collateral while at the same time minimizing future loss exposure for our clients.
